Case Studies

Narcotic Crime

The State of Illinois accused Mr. Levy’s client of delivering five kilograms of cocaine to undercover police officers; the defendant faced 15 to 60 years in prison if convicted. Although the defendant gave an oral statement to police admitting his involvement in the matter, Mr. Levy’s efforts at trial on behalf of his client resulted in a “not guilty” verdict on all charges. In addition, Mr. Levy also worked with the Immigration and Naturalization Service (INS) to drop its case to deport Mr. Levy’s client, who remains in the country.

Attempt Murder/Armed Violence

Mr. Levy’s client – accused of attempt murder, armed robbery, armed violence and aggravated battery- faced six to 30 years at the Illinois Department of Corrections if convicted. The state argued that the defendant was involved in a gang-related incident in which three gang members allegedly assaulted a rival gang member with a large piece of concrete. After a four-day trial, Mr. Levy secured a “not guilty” verdict for his client on the attempted murder and armed violence charges.

Felony DUI

Facing up to 30 years in prison for his sixth DUI, Mr. Levy’s client was accused of felony driving under the influence of alcohol. The court found defendant “not guilty” of all charges after trial at the 26th and
California courthouse.

Misdemeanor DUI

The police stopped Mr. Levy’s client was speeding and improper lane usage.  The client admitted drinking before driving. Mr. Levy’s client also had open containers of alcohol in his vehicle and completed the field sobriety tests.

At trial, the court found him not guilty after Mr. Levy effectively crossed examined the officers.

Burglary

The State of Illinois accused Mr. Levy’s client of illegally entering his ex-girlfriend’s house and taking jewelry, cash, and other valuables. Although an eyewitness allegedly saw the incident and identified the defendant in a photo lineup, Mr. Levy’s efforts at trial resulted in a “not guilty” verdict of all charges of his client.

Weapons Offense (Aggravated UUW)

At trial, Mr. Levy successfully argued that although the weapon was found in his client’s clothing, his client never possessed the weapon since he did not touch it or exercise control over it. His client was
simply in his bedroom near the weapon.

The court found his client “not guilty” of all charges.

Predatory Criminal Sexual Assault

Mr. Levy’s client was accused of sexually assaulting a neighbor and faced a long prison sentence if convicted. At trial, Mr. Levy challenged the victim’s memory of the incident and she admitted that she had a motive to lie about her allegations, resulting in a “not guilty” verdict.

Family Law - Child Custody/Child Support

Mr. Levy’s client was a man who owed more than $40,000 in child support for his three children. The client faced a life of debt and possible revocation of his driving privileges.

In court, Mr. Levy was able to prove that the children lived with their father more than half the time, so the mother did not have sufficient custody to entitle her to the requested child support.

Mr. Levy also helped his client gain full custody of the three children, who have lived with him since that time.

Divorce

Mr. Levy has handled many divorce and domestic relations cases. He has secured excellent results for his clients.

Secretary of State Hearings

Mr. Levy’s client had three DUI convictions and the Illinois Secretary of State revoked his driving privileges. The client, an admitted alcoholic, faced the prospect of never legally driving again.

The client followed Mr. Levy’s recommendations and completed alcohol and drug treatment with a highly-qualified treatment provider who then drafted the required documents for the formal Secretary of State hearing.

Even though his client only had a grade school education in Mexico, Mr. Levy was able to convince the Secretary of State to grant him a restricted driver’s permit to allow him to drive to and from work and treatment.

In the future, Mr. Levy will have another hearing to get full reinstatement of his client’s driving privileges.

Civil Rights Violations

Chicago Police officers from the Special Operations Section (SOS), a now defunct unit, raided Mexican bars on the south side.

The officers illegally searched bar patrons inside the bar, recovered narcotics, and arrested the patrons. The police immediately damaged the video cameras in the tavern, seemingly destroying evidence of their illegal raid.

However, a secret surveillance system captured the illegal searches causing the court to dismiss all of the felony drug cases. Mr. Levy’s associate sued the police and recovered damages. The prosecutor dismissed the felony drug charges against his clients.

Several of the officers later involved in the raid later went to jail, and the police were forced to disband the notorious SOS.

Personal Injury

One of Mr. Levy’s clients accused The Catholic Church of sexually abusing him while he was in a juvenile court program affiliated with the Church. The client, a Black juvenile, suffered years of mental anguish and pain caused by Father McCormack’s abusive actions.

Mr. Levy, along with co-counsel, secured a
large settlement that will help his client have closure and justice.
